This is going to sound strange so bare with me. Back in 1996, I started college and got a pre-approved credit cards. I keep it, but honestly never used it. I packed it away in a box and forgot about it. In 2004, my mom calls me and tells me a bill collector was calling for me (I hadn%26#039;t lived there since 1996) so I call him and he starts blasting me saying I owed them about 7000 for a Visa card. I told them they must have the wrong person, since I didn%26#039;t have a Visa, and he said that the charges went back to 1997. I still had no idea what he was talking about, so I said I would check into it. I honestly didn%26#039;t give it any more thought until my husband and I started looking at houses to buy, and the guy called me again. Turns out somehow my card got out there somehow, and someone maxed it out (1500 limit) Since the last charge was in 1997 shouldn%26#039;t it be removed from my credit? I haven%26#039;t had my credit report run yet, but since he is still calling, I%26#039;m worried it is still there

Your credit report will show two things up to the end of that 7-year window. It will show the credit card account (as charged off/sold) and the collection agency%26#039;s account. At the first day of the 8-year mark, the credit card listing on your credit report will fall off, but the collection agency listing will stay there because they are still actively chasing the money. You need to take a few steps: First, dispute the charges by writing a letter to the three bureaus, the credit card company and the collection agency. Request any and all information from the credit card company claiming that the card was never used and that no bill has ever been received. You%26#039;ll want any and all records of what was bought, where it was bought, and if shipped, where it was shipped to. If the credit card doesn%26#039;t have that information, the agency should becaus they have to prove the debt is yours somehow. When the credit bureaus contact the collection agency, the agency has to submit proof within 30 days or the bureaus will not put the account back on the report. The agency may refile to put the report back on, but you can counter that with letters to note the claim is not valid and has been previously removed as well as re-disputing the item with the bureaus. You will also want to notify the bureaus, the credit card and the collection agency that you may have been a victim of identity theft and since you comepletely dispute the charges that their next contact from you may be from a lawyer. Someone somewhere has to have deeper information on the account to lead you to find out what happened.

Actually it takes 7-10 years. But if along that time frame another company buys your debt from original company the time will start over again.

nope it going to stay on your credit report until it is showed as being paid off...you can always just call the visa company and tell them that you lost your card and all the charges that were made were unauthorized...i dont know if they will reverse them because its been almost 10 years...but its worth a shot

it is 7 years from date of last activity (payment ?) - go to www.annualcreditreport.com and pull all 3 bureaus and dipute the items on all three bureaus.

It is actually seven years fron the last activity date, like your last payment. I would call the credit card co to let them know that the card was stolen. Be sure to get your credit report. If you dispute the charge, they have to correct it within 30 days or remove it.

I work as a bill collector and what you need to do it report this acct as fraud. Call the cc company up and dispute the fradlnt charges and look at your credit report and see what it saids. most likely, it will say a charged off acct. (Meaning a 3rd party collection agency has this acct and was neglected for so many years). But next time a bill collector call- take it seriously- if you feel that you don%26#039;t owe or recall the bill- look into it. This could have been prevented from the get go. Having bad credit takes many years to repair while having good credit could be easily damaged fast.

First off, if you and your husband are seriously looking at houses, both of you need to know what is on your credit reports, for both of you, from each of the three credit bureaus. You do not want to be surprised by something (like this collection) that pops up right after you%26#039;ve found the house of your dreams.



Agreed with the others that you should report the card stolen, but it will be problematic since it was stolen back in 1996-7. Basically, the way the 7 years works is that it dates from the Date of Last Activity, so if someone took your card, they were free to charge it up until the credit card company cut them off, terminated the account, and deemed it a charge-off and passed it to collections, which may have taken months from the initial time it was stolen. In fact, if you contacted the credit card company to report the card stolen, they may not even have a file for you on their system since it has long been closed and passed to collections.



Your best bet would be to file a formal written dispute with the credit agencies and if the bureaus cannot verify it within 30-45 days (which is altogether possible because it%26#039;s been 10 years) then it has to come off of your report as a matter of law. Your first step, as I%26#039;ve said before, is to get copies of your credit report from each reporting agency - because that%26#039;s the only way for you to identify, specifically, the line item that you are disputing with the agency.

I am wondering where some of you are getting your information??? The SOL is 7 years from last activity...the account never starts over when someone else takes over the account. It%26#039;s the same account...if the account is bought after six years then the collection agency can only report it for one year...they can continue to persue payment...but cannot report it! If this is still on your credit report, then you need to dispute it and it will be taken off due to the age of the account! Plain and simple!



In 2004 that would have been right at 7 years, and it would have fallen off later that year. Chances are it%26#039;s not on any of your credit reports now. You need to have all three of your credit reports pulled to make sure nothing remains of this. Any collections for this account should have also fallen off the report with the original debtor.



Guys...read up on the law before posting! I can%26#039;t believe some of your answers! No offense meant to anyone but it%26#039;s not accurate to give false information! Read up on statue of limitations...okay????????
