Can credit agency reinsert a charge off after it has been deleted off credit report?

Recently had ballys total fitness removed from credit report through dispute but now it is back through a new agency. Is this legal, because I thought once it was deleted it cant be brough back......

It is legal.



Here is how the game is played. If you dispute the debt with the credit reporting agency, the creditor has 30 days to respond. If they fail to respond, the report is automatically deleted.



However, it can be re-inserted by the creditor. Then you have to go through the whole thing again (dispute letters).



Where you are screwing up is not asking the creditor to validate the debt. Validate means they must supply you with copies of contracts, bills, receipts, and everything they used to calculate what they claim you owe. The must show you have a legal obligation to pay this debt.



So send the collection agency a letter (see sample below). They have 30 days to respond back. If they fail to respond, send another letter to the credit reporting agency, with a copy of your validation request letter. (Be sure to send them certified mail, return receipt).



Demand again that they remove the listing due to %26quot;lack of validation%26quot;. If they still do not remove it, you can now sue them in small claims court for $1000.

Its strange that they would place it with 2 seperate agencies that report. Its probably technically legal, but speaking as someone who%26#039;s companies report, if you threaten a lawsuit or provide documentation of the original dispute and its not a lot of money, they will remove it. It isn%26#039;t worth the headache to them.
