I live in the uk and am having trouble in getting credit, so I got my credit report and I have a default on there from a credit company and it says the default date was 31st march 2004, then it says that the default satisfied date was 4th december 2006, so does this mean that the default is no longer valid? And if so how can I get this taken off?

Credit card companies merge and/or change names all the time....This could be the new name of a company that you previously had a card with. Closed/never late notations on your credit report are not negative. There%26#039;s no need to worry over this.

You have the legal right to (and absolutely should) dispute anything on your credit file that is incorrect. You do that by sending a written request to the credit bureau (remember that there are THREE of them!) stating that the information is incorrect and advising that you want the information corrected. They then have 30 days to correct the error or to remove the reporting.

Do not call the collectors. Instead send them a certified, return receipt letter indicating the debt is not yours and unless they can provide contracts and other documents that prove this is your debt within 30 days, they should cease and desist contact you. They have to stop contacting you.



Keep copies of the letter with your important financial papers. It is likely the collector will sell the debt off to another agency and you%26#039;ll have to send another cease and desist letter.

I was viewing my credit report and my scores are all fairly decent 744 exp, 735 equi, and 748 TU but i have a collection agency entry from ASSET ACCEPTANCE CORP. If you see anything that is incorrect about any entry on your report you need to report it to them according to the directions on the credit report. Basically what happens next is the credit reporting agency sends a request to the company who reported the item asking them to correct it. If they do not respond in the time required, normally 30 days that item has to be removed from you report. It might be something as simple as the balance, or last payment date, misspelling. Whatever the error report it. Many times if the account is paid the company will not respond and therefore it has to be removed from your credit report by default. This may help get some entries off the report. All legitimately. You are doing this to at the very least to get the information on the reports corrected. Remember this when it comes to hiring a credit repair company

Ok, as I understand it you have some items that went into collections, but you paid them back.



And now you still have bad credit because even though the now say paid, they still have comments about late payments, collections and charge off%26#039;s. Right?



This is exactly what I have been warning people about for months. It%26#039;s so amusing to see these collection agents come here and tell people to pay their bills and their credit will be restored. Now you can help me spread the truth! First hand experience!



The TRUTH is that there are only two ways you can get a negative item removed from your credit report.



1) The creditor fails to respond to a dispute investigation from the credit bureau.



2) The creditor must remove it himself.



So here is your problem. The creditor now has your money. You have absolutely no leverage over him to help you in restoring your credit. You can ask him politely to delete the bad mark, but I have had very little luck in doing this for my clients once the bill has been paid.



What you needed to do was get the creditor to agree IN WRITING to delete the entry before you paid them a dime. Now, unfortunately, you have lost any advantage you may have had.



You can still file a dispute, but all the creditor has to do is answer back that it%26#039;s correct and it will stay on your record for the required 7 years. There is a chance that the creditor may have lost your file (it%26#039;s now paid...why keep it)...or just doesn%26#039;t want to waste their time searching. This is how many credit repair agencies managed to get some items removed.



As for adding comments to your credit report, that will give your side of the story...please don%26#039;t waste your time. Credit scores do not take this info into account when calculating them....and most creditors don%26#039;t look at the full report unless it%26#039;s a major purchase. And they rarely look at the comments either.



Just take this as a lesson learned, and help me pass the work about the correct procedure in paying back collection agents.

It happens all the time.

There are exceptions, and without knowing all of the details, I have a feeling this is what you may be seeing. When a company %26quot;Charges-Off%26quot; an account because of non-payment they will sell the account to a collection agency. You will then see the Charge-Off from the original creditor(in your case Chase), and another account from the Collection Agency. This is also totally legal.



Another exception could be if the company was bought out by another company. You will see the same account information broken up into two records. However, the first record will stop at a specific Month/Year and the new information will pick it up from there. This does not happen very often, because the new bank%26#039;s name will usually just replace the old bank. But it could happen.

I bought a car with a 3 year finance term. I paid the car every month on time, and finally I have paid it off! My credit is poor, so I wanted to rebuild my credit this way. Unfortunately the dealership I bought from does report to the credit agencies if you have purchased a used car.



They did however, write a letter that states I paid every month in full, and on time until the car was paid for outright.

The car dealer was a broker for the finance company that lent you the money, (they %26quot;introduced%26quot; the finance to you so that you could buy their car). That is why the car dealer does not get involved on this;(likely they finance new cars themselves instead). The finance company would have done a credit search on you when you took out the loan and would have monitored as you paid each month. They may not have passed the info onto the credit agency (yet). Or may be that the credit agency already knows about you, (but the car dealer wouldn%26#039;t know this). So you needed to find out this first.



You need to find out who the finance company was (it is easy is it?), then ask them what credit agency(ies) they deal with. Your last monthly statement will show that you have paid it off, so you can include a copy of it too.

All in all not very consumer friendly. Guess that is what happens when a big company is required to do something they do not want to do.

Yes, the company can continue to try to collect, even if you are past the collecting SOL. Though they cannot legally sue on a time barred debt.



(Collection agencies do illegally sue quite often on time barred debts. Usually the people they sue do not know their rights, do not use them and end up having a default judgment filed on them)



Much of what you would do as far as paying/not paying depends on many things - your collecting SOL and where you are at in it, who you are dealing with - the original creditor (and which one) or dealing with a collection agency, if they are reporting accurately or not, etc., etc., etc.



The reporting SOL %26quot;cannot%26quot; legally be re-aged. No matter if the charge offs are paid or just jump from collection agency to collection agency. The charge offs can only legally report for the original amount of time.

As for the lates that you are paying, after they are paid you might send the creditors a goodwill letter explaining why you were late and request that they remove the lates.



Depending on your reasons why you were late (just forgetting to send a payment is a very poor reason) a creditor may work with you and remove the lates.



Lates are a major score killer and will remain on your reports for 7 years from the late.

You will probably have to place them with a collection agency. The money that they owe you would then show on their D%26amp;B which can hurt them when they try to get credit from other businesses.



Small Claims court could work depending on how much they owe you. But just know even if you were to be awarded a judgement, doesn%26#039;t mean you automatically get the money. You almost always have to fight to get that. But again, it should at least show as a negative item on their D%26amp;B.

Here is how the game is played. If you dispute the debt with the credit reporting agency, the creditor has 30 days to respond. If they fail to respond, the report is automatically deleted.



However, it can be re-inserted by the creditor. Then you have to go through the whole thing again (dispute letters).



Where you are screwing up is not asking the creditor to validate the debt. Validate means they must supply you with copies of contracts, bills, receipts, and everything they used to calculate what they claim you owe. The must show you have a legal obligation to pay this debt.



So send the collection agency a letter (see sample below). They have 30 days to respond back. If they fail to respond, send another letter to the credit reporting agency, with a copy of your validation request letter. (Be sure to send them certified mail, return receipt).



Demand again that they remove the listing due to %26quot;lack of validation%26quot;. If they still do not remove it, you can now sue them in small claims court for $1000.

Always deal with a collector by mail and sent certified return receipt (create a paper trail). Never admit to an unvalidated debt with anyone.

There%26#039;s no obligation for a debt collector to not report it.



Chances are the debt is already on your report, and if it has been deemed a charge-off, the DC cannot report it again. It can only report new information.



If the debt has been sold to another, and the debt has been reported to the credit bureau, it is still the same debt and can%26#039;t be reported again. Once again, only new information can be reported.



You have 30 days from when you receive notice to dispute the debt. It is important you do so, even if you owe. They will have to provide proof of the debt and this is to your benefit, if they decide to sue you. If they don%26#039;t provide the info and sue you anyway, they are in violation of the law and you can sue them.



If they check and can%26#039;t provide proof (maybe they lost it) then legally they are supposed to remove the debt from the report altogether.



But, if they have the proof, they can leave it there.



You can negotiate how much you will pay and what the conditions are. So, you can negotiate possible removal of the debt altogether from your report, or just make the report less harsh. Do this in writing.



Depending upon how old the debt is, it may be legally uncollectable. PAY THE BILL. Your late payment or non-payment will indeed show on your credit report. But, there will be updates to the report that will show that you...



A) Eventually paid the entire balance, albeit late.



B) Paid very very late.



C) Never paid at all (total deadbeat int he eyes of other creditors).



The best thing you can do to save your credit is to pay what you owe. That way, your credit resport will be updated to show (A) that your account was sent to collections but you paid in full. That%26#039;s much better on your credit report than (C) where you never paid the overdue balance at all. If you do that...then you%26#039;re really screwed.

Much of what happens to the debt depends on the statute of limitations (SOL) for collection in your state.



If you are still within the collecting SOL, they can actively persue payment. Which includes possibly suing.



If you are to be out of the collecting SOL, a collector (CA) or the original creditor (OC) can still actively persue payment but cannot legally sue. (even though it is illegal to sue on a time barred debt, they still do it)



A CA can try to collect basically forever unless you let them know, in writing, that the debt is time barred and to cease all contact with you. (a full cease %26amp; desist is not recommended while still within the collecting SOL)



A credit card charge off will remain on your reports for 7 years from the first time you became 30 days late and never brought the account current leading to the charge off, no matter if it is the OC or the CA (or both) who is reporting.



(If it remains on your reports for the full 7 years keep a close eye on it for re-aging)



If both the OC and a CA are reporting the same debt, the OC %26quot;must%26quot; show the account with a zero balance.



If it is reporting correctly theres not much you can do about it. If it is reporting incorrectly you can dispute it and legally they would either have to correct it or delete - sometimes the data furnisher (OC/CA) will just verify the inaccuracies and you would have to fight the CRA%26#039;s and the data furnishers to comply with the FCRA.



A paid negative is no better than an unpaid negative.



If you plan on paying be sure to send the CA a debt validation letter, then after they validate (ha, like that would happen) send a pay for delete letter demanding, among other things, that they delete any negatives tradelines they have placed on your credit reports.



If it is still with the OC, you can request debt verification, though they don%26#039;t have to respond unless your state holds OC%26#039;s the same as CA%26#039;s, and then request pay for delete.
